Brazilian Regulatory Standard No. 1 (NR-1) Updated: Mental Health–Focused Inspections Begin in May

The update reinforces organizations’ responsibility for preventing psychosocial risks in the workplace.

By Julhi Bonespírito

Legale Overseas, no. 966.

As of May 26, 2026, mandatory inspection of psychosocial risks under the revised Regulatory Standard No. 1 (NR-1) will come into effect. This change represents a significant advancement in the protection of mental health at work and will require all companies, regardless of size, to technically assess factors such as stress, harassment, burnout, and other elements that affect employee well-being.

What changes

With the explicit inclusion of these factors in Occupational Risk Management (GRO) and the Risk Management Program (PGR), organizations will need to demonstrate:

• whether psychosocial risks exist in the workplace;
• how these risks were assessed;
• which measures and action plans will be implemented.

The new focus of inspections

Inspections by the Ministry of Labor and Employment (MTE) are expected to focus more deeply on how work is organized. Working hours, targets, overload, internal conflicts, ergonomics, and absenteeism due to psychological reasons will be closely examined.

Auditors may also cross-check information to verify whether companies, even those that already have well-being or mental health initiatives, are effectively aligned with the technical guidelines set out in the NR-1 update.

This trend signals a clear potential increase in labor disputes involving mental health. The absence of psychosocial risk management may facilitate the demonstration of employer liability in cases of burnout, depression, or occupational anxiety.

Why act now

Proactive compliance avoids unnecessary costs, reduces the risk of fines, and strengthens the company’s legal security. Assessing risks carefully—avoiding the inclusion of generic or irrelevant elements—is the safest way to comply with the standard and protect the business.

Inspections are imminent. Being prepared is not only mandatory—it is strategic.

Vaz de Almeida Advogados advises companies on NR-1 compliance, focusing on the technical identification of psychosocial risks, structuring internal processes, and mitigating labor liabilities.
